1. About These Terms

These Terms of Service ("Terms") are a legal agreement between you and Stacksy Pty Ltd (ACN 691 241 291), trading as AnonaVoice ("AnonaVoice", "we", "us", "our"), governing your use of the AnonaVoice platform accessible at app.anonavoice.com and anonavoice.com ("the Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

AnonaVoice provides a platform that enables organisations to receive anonymous feedback, reports, and disclosures from individuals, and to conduct secure two-way communication with those individuals without either party knowing the identity of the other.

The Service is intended for legitimate workplace feedback, whistleblowing, and organisational transparency purposes.

3. Two Types of Users

Organisation Admins create and manage an account on behalf of an organisation. By signing up, you represent that you have authority to bind the organisation to these Terms.

Anonymous Users access the Service through a link provided by an organisation to submit reports. Anonymous users do not create accounts and are not required to agree to these Terms to submit — however, use of the Service for any purpose constitutes acceptance.

4. Account Registration (Organisation Admins)

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your login credentials
  • You must notify us immediately of any unauthorised access to your account
  • One account per organisation unless additional admin users are added through the platform
  • You must be at least 18 years old to create an account

5. Subscriptions and Billing

First month free: New organisation accounts receive their first month at no charge. Your payment method will be charged from the second month onwards unless you cancel before the free period ends.

Billing cycle: Subscriptions are billed monthly in advance. The billing date is set at the end of your free first month and recurs on the same date each month.

Pricing: Current pricing is displayed at anonavoice.com/#pricing. We reserve the right to change pricing with 30 days' notice to existing subscribers.

Cancellation: You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.

Failed payments: If a payment fails, we will notify you by email. If payment is not resolved within 14 days, your account may be suspended. Data is retained for 90 days following suspension.

Payment processing: Payments are processed by Stripe. By providing payment details, you also agree to Stripe's Terms of Service.

6. Acceptable Use

You agree not to use the Service to:

  • Submit false, defamatory, or malicious content
  • Harass, threaten, or intimidate any individual
  • Attempt to de-anonymise or identify other users
  • Transmit malware, spam, or automated submissions
  • Circumvent any technical measures we implement to protect the platform
  • Use the Service for any unlawful purpose under Australian law
  • Impersonate any person or organisation
  • Scrape, index, or extract data from the platform without written permission

We reserve the right to suspend or terminate accounts that violate these rules, without notice where necessary to protect users or the integrity of the platform.

7. Anonymity — Important Limitations

AnonaVoice is designed to protect anonymity at a technical level. However, we cannot guarantee anonymity if you include identifying information in your messages. Do not include your name, role, unique details, or anything else that could identify you in your submission.

AnonaVoice is not a substitute for legal whistleblower protections. If you are making a disclosure that may have legal consequences, we recommend seeking independent legal advice. The Corporations Act 2001 (Cth) and related legislation may provide additional protections depending on your circumstances.

8. Content

You retain ownership of any content you submit through the Service. By submitting content, you grant AnonaVoice a limited licence to store and transmit that content solely for the purpose of providing the Service.

Organisation admins are responsible for the content submitted through their channel and for how they respond to it. AnonaVoice does not moderate or review submissions unless required to do so by law.

9. Availability and Support

We aim to provide a reliable service but do not guarantee 100% uptime. We may perform scheduled maintenance with advance notice where possible.

10. Intellectual Property

The AnonaVoice platform, branding, and all associated software are owned by Stacksy Pty Ltd. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary technology outside of your normal use of the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by Australian law. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, AnonaVoice's total liability to you for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us in the three months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Australian law.

13. Indemnity

You agree to indemnify and hold harmless AnonaVoice and its officers, employees, and agents from any claims, losses, or damages arising from your violation of these Terms or misuse of the Service.

14. Termination

Either party may terminate the agreement at any time. You may cancel your subscription through the billing portal. We may terminate or suspend your account immediately if you breach these Terms.

On termination, your access to the Service ceases. Organisation data is retained for 90 days following termination before permanent deletion, after which it cannot be recovered.

15. Changes to These Terms

We may update these Terms from time to time. We will notify organisation admins of material changes by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, unless otherwise required by the Australian Consumer Law.
